End User License Agreement

By installing or using the Hyperon software, you agree to the terms of following End User License Agreement (EULA):

This EULA may be amended from time to time. The respective latest version of the EULA at the point of time of the purchase/registration of a Hyperon software (whichever occurs later) shall apply.

Website ownership

1) The products, services and materials on this website (all together referred as the "Website") are protected by copyright, trademark, trade dress, patent, trade secret, unfair competition, and other intellectual and proprietary rights (the "Intellectual Property Rights"). Except as expressly provided in the terms, Decerto and its suppliers do not grant any express or implied rights to use the materials.

2) The trademarks, logos and service marks displayed on Website (the "Marks") are the property of Decerto or third parties. You are not permitted to use the Marks without the prior consent of Decerto or the third party that may own the Marks.

Modifications to the Website, service interruptions

1) Decerto may at any time and from time to time modify or discontinue, temporarily or permanently, the Website, or any portion thereof, with or without notice. You agree that Decerto shall not be liable to you or any third party for any modification, suspension or discontinuance of the Website.

2) There may be unanticipated interruptions in the availability of the Website, or any portion thereof. You agree that Decerto shall not be liable to you or any third party for such interruptions regardless of the duration of the interruption. Notwithstanding the foregoing, Decerto will use commercially reasonable efforts to remedy any such interruption expeditiously.

Limitation of liability

Decerto will not be liable to you in respect of: any loss of profits or anticipated savings; any loss of revenue or income; any loss of business, contracts or opportunities; any loss or corruption of any data, database or software; any special, indirect or consequential loss or damage; arising out of or in connection with your use or access to the Website.

Decerto does not control, endorse or accept responsibility for any materials or services offered by third parties accessible through linked sites. Decerto makes no representations or warranties whatsoever about, and shall not be liable for, any such third parties, their materials or services. Any dealings that you may have with such third parties are at your own risk.

Decerto is not be liable for any loss that you may incur as a result of someone else using your password or account or account information in connection with the Website, either with or without your knowledge.

Decerto's aggregate liability and that of its affiliates and suppliers under or in connection with your use or access to the Website shall be limited to one hundred fifty United States dollars ($150) or the aggregate amount paid by you for access to the Website, whichever is larger. This limitation will apply even if Decerto has been advised of the possibility of such damages and notwithstanding any failure of essential purpose of any limited remedy.
